Flora Cooking With Schools Terms & Conditions 2010

  • January to March 2010: Special packs of Flora available, while stocks last.
  • Midday (GMT) 26th April 2010: Closing date to register your school.
  • Midday (GMT) 5th May 2010: Schools with highest token count at this date will have the total value of their tokens tripled. Schools with the 2nd highest token count at this date will have the total value of their tokens doubled.
  • Midday (GMT) 5th May 2010: Closing date for registration of all token codes.
  • Midday (GMT) 7th May 2010: Final token counts available (for schools and consumers signed up to the Collector's Zone).
  • Midday (GMT) 10th May 2010 to midday (GMT) 30th June 2010: Ordering period. Orders received after midday (GMT) 30th June 2010 will not be valid.

Eligibility
Schools
  1. The Flora Cooking with Schools scheme (the "Scheme") is restricted to schools in the UK, Isle of Man ("IOM"), Channel Islands ("CI") and Republic of Ireland ("ROI") only.
  2. To be eligible to participate in the Scheme, your school must:
    1. be registered with your LEA or the Department of Education and Science (ROI);
    2. be subject to OFSTED Inspections or the Department of Education and Science Inspectorate (ROI); and
    3. be a primary school; or
    4. be a middle school that the DCSF (Department for Children Schools and Families) has designated as having primary school status.
  3. If you are not sure whether your school is eligible, please contact the Promoter (see section 63 for details).
  4. Only the authorised representative of the school can register the school and order cooking equipment.

Consumers
  1. Consumers may participate in the Scheme by collecting and registering tokens available on special packs of Flora spreads.
  2. Under 18's should ask for parental/ guardian consent before participating in the Scheme.
To top
Registering an eligible school
  1. Eligible schools must be registered at www.cookingwithschools.com (the "Website") in order to participate in the Scheme.
  2. The closing date to register schools is midday (GMT) 26th April 2010.
  3. In order to register schools should visit the Website and complete the short registration form. When providing contact details, please provide a school email address rather than a personal one wherever this is possible.
  4. The individual that registers their school will be deemed to have the authority to register the school and have the capacity to accept these terms and conditions on behalf of the school.
  5. Once registered, schools will receive a unique login in and password.
  6. A school is free to opt out of the Scheme at any time. A school can opt out by visiting the school registration page on the Website or by contacting us (details at 63 below). If a school decides to opt out of the Scheme, any tokens registered against it may be re-distributed (see 26 for details) and if any such tokens have been re-distributed it will not be possible to 're-credit' them to the school should they later decide to re-join the Scheme.
  7. By participating in the Scheme, a school gives its consent to the Promoter to use its name and town in press and publicity materials to promote the Scheme. Schools may be required to participate in further publicity in connection with the Scheme.
  8. The Promoter reserves the right to disqualify a school that has registered for the Scheme but is subsequently found to be ineligible.

Token Registration
  1. Cooking with Schools tokens can be found on the following special packs of Flora spreads: Flora Original - 250g, 500g, 1kg; Flora Buttery - 500g, 1kg; and Flora Light - 250g, 500g, 1kg.
  2. The following amounts of tokens will be available on the packs: 1 token on 250g packs; 2 tokens on 500g packs and 5 tokens on 1kg packs. 1 token will represent a value of 20p/30c; 2 tokens on 500g packs are worth 40p/60c and the 5 tokens on 1kg packs are worth £1/€1.50.
  3. Special packs will be available from January 2010 until the end of March 2010, while stocks last.
  4. To register tokens, log on to the Website, select which school(s) you are supporting (schools can be found by town or name) and enter your unique token code(s) in accordance with the instructions.
  5. Some schools may offer to collect and register tokens. Please contact your school for details.
  6. All token codes must be registered on the Website (either by you or by your school(s)) by no later than Midday (GMT) 5th May 2010 in order to be included in the final token count (for further consumer details see section 64:Collector's Zone). Any token codes submitted after this date will not be counted.
  7. Codes can be used once only. Only the unique codes found on the special packs of Flora spread are valid. All codes are subject to verification.
  8. Tokens may not be transferred between schools, organisations or individuals for monetary payment or any other consideration.
  9. Schools may organise other bodies/individuals to collect tokens on their behalf, but final orders for cooking equipment must be made directly by the registered school.
  10. The Promoter cannot accept responsibility for token codes entered incorrectly. Please enter codes carefully. Responsibility is not accepted for token codes lost or delayed as a result of any network, computer hardware or software failure of any kind.
  11. Tokens can only be used in accordance with the terms of this Scheme. Any token codes not entered in accordance with these terms and conditions will not be valid.
To top
Tokens for invalid or non-participating schools
  1. Tokens entered for invalid, disqualified, non-participating schools or schools which have opted out, will be accumulated until the closing date for registration of tokens. These accumulated tokens will be apportioned fairly, on or after midday (GMT) 5th May 2010, between all remaining participating schools who have a token count on midday (GMT) 5th May 2010 of 1 token and above.
  2. If a token is registered for an invalid or non-participating school and the consumer who registered the token is a member of the Collector's Zone, the token will remain valid for the consumer and count towards their personal token total.

Fraudulent activity
  1. In the event that the Promoter suspects fraudulent activity by a school or consumer, the Promoter reserves the right to investigate the suspected fraudulent activity, disqualify the school or consumer and/ or withhold delivery of cooking equipment until the Promoter is satisfied that the school or consumer has acted in accordance with these terms and conditions.
  2. In the event that a school or consumer is disqualified for fraudulent activity, the Promoter reserves the right to re-distribute their tokens to other participating schools and consumers, if it is possible to do so.

Ordering: schools
  1. Properly registered tokens can be exchanged for the cooking equipment listed on the Website. For the purposes of such an exchange, each token will represent a value of 1 x 250g token = 20p/30c, 1 x 500g token = 40p/60c, 1 x 1kg token = £1/€1.50.
  2. There is no limit to the number and value of tokens which may be collected, but the Scheme is restricted to one (1) order for cooking equipment per school made during the Ordering Period.
  3. Schools will be able to find out their final token count from midday (GMT) 7th May 2010 by logging on to the Website.
  4. Schools with a final token count of 50 tokens or more will be able to log on to the Website and order cooking equipment to the total value of their registered tokens from midday (GMT) 10th May 2010 to midday (GMT) 30th June 2010 (the "Ordering Period"). Orders received after midday (GMT) 30th June 2010 will not be valid.
  5. Once the order has been accepted it can not be changed.
  6. Please visit the webshop on the teacher's section of the Website for further details relating to the ordering of cooking equipment.

Final token count of between 1 and 49 tokens: schools
  1. There is a minimum value of 50 tokens for orders of cooking equipment.
  2. Schools with a final token count of between 1 and 49 tokens can order a special gift pack containing pre-selected cooking equipment, detailed below:
    1 x 4.5 litre mixing bowl
    1 x Set of four stainless steel measuring spoons
    1 x White spatula
    1 x Oven glove
    1 x Baking sheet
    1 x Bun tray
  3. In order to receive the special gift pack, schools with a final token count of between 1 and 49 tokens should log on to the Website during the Ordering Period and follow the on-screen instructions in the Webshop section of the Website.

Cooking Equipment: schools
  1. All cooking equipment is subject to availability. The Promoter reserves the right to introduce new items or remove existing items during the Scheme.
  2. In the unlikely event that items you have ordered become unavailable the Promoter will substitute similar items of equal or greater value.
  3. All product descriptions, dimensions and images of the cooking equipment on the Website are correct at the time of publication; however, the images are for illustrative purposes only.
  4. For up to date information about the items on offer, please visit the webshop section of the Website, which will be regularly updated during the Ordering Period.

Delivery: schools
  1. Delivery will be made directly to the registered school's address. Address details can be updated throughout the Scheme on the Website.
  2. We will endeavour to deliver your order within 28 days of the order being placed. However, if the 28 day period falls within your school holidays, delivery will be made at the earliest convenient opportunity after the school recommences.
  3. Holiday periods must be notified to the Promoter on ordering of the cooking equipment to ensure that deliveries are made at times when the school is open. It is the responsibility of the school to ensure that the correct holiday dates are notified. Failure to do so may result in delivery during the holidays or late delivery.
  4. There will only be one delivery of cooking equipment per school, with the exception of the portable oven and trolley which, if a school has ordered these items, will be delivered separately.
  5. Deliveries will take place Monday to Friday between the hours of 8.30am and 4.30pm (GMT).
  6. Cooking equipment must be checked and signed for on delivery by an authorised member of staff. The number of packages delivered must be checked in the presence of the driver. It is the responsibility of the school to ensure that an appropriate person is available at the delivery address.
  7. Please note that adverse weather conditions or other events outside of the Promoter's (or their agents) reasonable control may result in late delivery.

Damaged goods and incorrect or incomplete orders: schools
  1. Schools should retain the delivery note and original packaging as this may need to be returned in the event of a problem with the cooking equipment or order.
  2. Claims for damaged goods, incorrect items or shortages in the number of boxes delivered should be made at the time of delivery, or in any event within 24 hours of delivery.
  3. Claims should be made by contacting the Promoter via the dedicated Careline: on 0800 44 64 64.

User Generated Content ("UGC")
  1. You shall be responsible for any photographs, graphics, text, data and other content that you submit, post or display on the Website. By submitting UGC you agree to automatically grant Unilever an irrevocable, non-exclusive, royalty free, worldwide, sub-licensable right and licence to use, reproduce, modify, adapt, make available to the public and exercise all copyright and publicity rights in and to your UGC, and to incorporate your UGC in other works in any media in perpetuity in connection with the Scheme.
  2. You hereby waive any moral rights (or similar, related or neighbouring rights) which you may have in or to your UGC. If you do not wish to grant these rights to the Promoter, please do not submit your content for use on or through the Website.
  3. All UGC uploaded onto the "success stories" section of the Website will be reviewed by a third party moderator prior to upload to ensure that it is suitable for inclusion on this site.
  4. The Promoter and / or moderator have the right at their absolute discretion to remove any UGC from the Website that they believe is or could reasonably be construed as being unlawful, unsuitable or contrary to these terms without notice.
  5. If you see any content on the Website that you believe is or may be unlawful, abusive, threatening, offensive or otherwise contrary to these terms please contact us, or use the "report abuse" function and we will investigate your concerns and, if appropriate, remove such content.
  6. You hereby warrant that any UGC you submit, post or display on the Website is your own original work and that you have the right to make it available to the Promoter and any other applicable third parties for the purposes envisaged under these terms.
  7. You warrant that you have the permission of any individuals portrayed, referred to or featured in the UGC, or where those portrayed, referred to or featured are under 18 years of age, the permission of their parent/guardian.

Data protection
  1. By participating in the Scheme, a school gives its consent to the Promoter to make contact, provide materials and request information from it in relation to the Scheme.
  2. By registering for the Scheme or submitting the token codes, all participants will be deemed to have accepted and be bound by these terms and conditions and where applicable, consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this Scheme and any other purposes to which the participant has consented. All registration, token and order instructions form part of these terms and conditions.

Liability
  1. To the fullest extent allowed by law, the Promoter shall not be liable for any damages, claims or costs, however incurred, arising from this Scheme, the use of the cooking equipment purchased with the tokens or the failure by a school to follow the instructions set out in these terms and conditions.
  2. Nothing in these terms and conditions shall exclude or in any way limit the Promoter's liability for fraud, or for death or personal injury resulting from our negligence.

Collector's Zone
  1. The closing date to register tokens is Midday (GMT) 5th May 2010.
  2. In order to participate in the Collector's Zone, consumers must visit www.cookingwithschools.com (the Website), register at least one Cooking with Schools token found on special tubs of Flora and complete the short registration form.
  3. A consumer is free to opt out of the Scheme at any time. A consumer can opt out of the Collector's Zone by contacting us on 0800 44 64 64. If a consumer decides to opt out of the Collector's Zone, any tokens registered against their campaign will become null and void and it will not be possible to 're-credit' them to the consumer should they later decide to re-join the Scheme.
  4. By participating in the Scheme, a consumer gives their consent to the Promoter to use its name and town in press and publicity materials to promote the Scheme. Consumers may be required to participate in further publicity in connection with the Scheme.
  5. For a token to count towards a consumer's total, the consumer must be logged in to the Collector's Zone using their unique username and password at the time of registration.
  6. For a consumer to be eligible for the reward pack, they must have registered 12 Cooking with Schools tokens found on special tubs of Flora. 1 token will represent a value of 20p/30c; the 2 tokens on 500g packs are worth 40p/60c and the 5 tokens on 1kg packs are worth £1/1.50€.
  7. Reward packs will be sent to the address provided by the consumer via the online form
  8. Orders for reward pack orders received after midday (GMT) 30th June 2010 will not be valid.
  9. One household is entitled to one pack only.
  10. If a consumer's personal token count exceeds the 12 token required to claim a reward pack, they will not be entitled to any additional reward.
  11. There will be no cash alternative offered in exchange for the reward pack.
  12. Consumer's final token count will be available from Midday (GMT) 7th May 2010 by logging on to the Website.
  13. The reward pack will contain the below:
    1 x Children's bib aprons 100% cotton
    1 x Flora money off coupon (full Terms & Conditions as documented on the back of the coupon will apply)
    Recipe cards
  14. The Promoter reserves the right to introduce new items or remove existing items to the reward pack during the Scheme.
  15. In the unlikely event that items in the reward pack become unavailable, the Promoter will substitute similar items of equal or greater value.
  16. Claims regarding damaged goods should be made by contacting the Promoter via the dedicated Careline: on 0800 44 64 64
  17. Reward packs will be sent out within 28 days of the end of the Ordering Period. Please note that adverse weather conditions or other events outside of the Promoter's (or their agents) reasonable control may result in late delivery.
  18. Deliveries will take place Monday to Friday between the hours of 8.30am and 4.30pm (GMT).
  19. By subscribing to the Collector's Zone, consumers give consent to the Promoter to make contact , provide materials and request information in relation to the Scheme. Consumers will also receive regular email updates on their progress. They will be able to unsubscribe from these updates using the unsubscribe link at the bottom of their email.
  20. Reward packs are subject to availability.

General
  1. By participating in the Scheme, you agree to be bound by these terms and conditions.
  2. You agree that you have read and accept the Website Legal Notice and Privacy Policy. If there is any conflict between the Legal Notice or the Privacy Policy and these terms and conditions, these terms and conditions shall prevail.
  3. By participating in the Scheme you hereby warrant that all information submitted by you is true, current and complete.
  4. If any of these terms and conditions is held by any court or competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

Law and jurisdiction
  1. As concerns UK, Channel Islands and Isle of Man residents, these terms and conditions shall be governed by the law of England and Wales and the courts of England shall have exclusive jurisdiction. As concerns ROI residents, these terms and conditions shall be governed by the law of Ireland and the Irish courts shall have exclusive jurisdiction.

  1. Open to residents of Great Britain only, excluding employees of the Promoter, their families, agents or anyone professionally connected with the Promotion.
  2. To claim your 'For Kids By Kids' Cook Book purchase any 3 Flora spreads between 1 January 2010 and 1 June 2010 at any ASDA store and send your ASDA receipts as proofs of purchase along with your name and address to: Flora Cook Book Offer 'ASDA', FREEPOST RRLT-EEAS-XBSJ, PO BOX 7557, Derby DE1 0NP
  3. No photocopies will be accepted. No applications from agents, third parties or organised groups. Incomplete or illegible applications or those not in accordance with these instructions will not be accepted
  4. Closing date for receipt of applications is 14 June 2010.
  5. Responsibility is not accepted for applications lost, damaged or delayed in the post. Proof of posting is not proof of receipt. Receipts will become the property of the Promoter and will not be returned.
  6. Cook Book will be sent by post to address provided upon receipt of valid application received by closing date. No cash alternative.
  7. Cook Book will be delivered within 28 days of receipt.
  8. By entering the Promotion, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this Promotion and any other purposes to which the entrant has consented. All entry instructions form part of the rules.
  9. This Agreement and any issues or disputes which may arise out of or in connection with this Agreement (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. The parties hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
